1. SCOPE
The following general terms and conditions apply to orders placed through our online shop by consumers and businesses. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to their commercial or independent professional activity. Business owners are natural or legal persons or partnerships with legal capacity who, when concluding the legal transaction, are acting in the exercise of their commercial or independent professional activity. The following applies to businesses: If the business owner uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted. They will only become part of the contract if we have expressly agreed to them.

2. CONTRACTUAL PARTIES, CONCLUSION OF CONTRACT
The purchase contract is concluded with Noanger GbR, Langemarkweg 56, 51465 Bergisch Gladbach. The address and other contact details can be found under Section 12. By placing a product in the online shop, Noanger GbR makes a binding offer to conclude a contract for this item. You can initially place the product in your shopping cart without obligation and correct your entries at any time before submitting the binding order by using the tools provided during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. You will receive a confirmation by email immediately after submitting the order. A binding contract may be concluded beforehand, depending on the payment method:

• Credit card payment: The contract is concluded at the time the credit card is charged.

• Direct debit: The contract is concluded at the time the account is debited.

• PayPal / Apple Pay / Google Pay: The contract is concluded at the time you confirm the payment order.
  The language of the contract is German. We do not save the text.

3. DELIVERY CONDITIONS
Shipping costs are added to the stated product prices. Further details on the shipping costs, or if applicable, whether shipping costs are waived, can be found in the respective offers. We only ship by mail. Personal pickup of the goods is not possible.

4. PAYMENT, PRICES
We offer the following payment options:

The prices displayed in our shop are final prices plus shipping costs. Pursuant to Section 19 of the German Value Added Tax Act (UStG) and Section 1 of the German Ordinance on Payment of Purchases (PAngV), no sales tax is charged and therefore not shown. Noanger GbR is a small business.

5. RIGHT OF WITHDRAWAL
Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Businesses are not granted a voluntary right of withdrawal.

6. RESERVATION OF TITLE
The following applies to consumers: The goods remain our property until full payment has been made. The following also applies to businesses: We retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business. You assign to us in advance all claims arising from this resale – regardless of whether the reserved goods are combined or mixed with a new item – in the amount of the invoice amount. We accept this assignment. You remain authorized to collect the claims. However, we may also collect claims ourselves if you fail to meet your payment obligations.

7. TRANSPORT DAMAGE
If goods are delivered with transport damage, please report this to the delivery service if possible and contact us. Failure to file a complaint or contact us will not affect your statutory rights, in particular your warranty rights. These rights remain in effect regardless of any complaints. By doing so, you will help us assert our own claims against the freight carrier or transport insurance.

8. WARRANTY

9. LIABILITY
Liability is not limited to consumers (see section 1). The following applies to businesses:
We are liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents:

• in case of injury to life, body or health

• in the event of intentional or grossly negligent breach of duty

• insofar as the scope of application of the Product Liability Act is open.
  In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely, we shall only be liable for slight negligence if the damage was foreseeable at the time the contract was concluded and its occurrence was typically to be expected.

10. DISPUTE RESOLUTION
Alternative dispute resolution according to Art. 14 para. 1 ODR-VO and Section 36 VSBG:

11. FINAL PROVISIONS
If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant within the meaning of the German Commercial Code (HGB) or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is the court with jurisdiction over our place of business: the Bergisch Gladbach District Court or the Cologne Regional Court (depending on the value of the proceedings).
